Privacy Policy

Introduction
We have developed this privacy policy to help you understand how we collect and use the personal information that you provide to us when using our website located at www.pondigo.com.  We hope that this will allow you to make informed decisions about disclosing this information.

The Information We Collect
As you use our website, we may collect two types of information:  personal information that you knowingly choose to disclose to us, and information about how you use our website that is automatically collected by our website.

When you register on our website and subscribe to our services, you create your own public profile.  Your public profile includes personal information, such as your gender, age, educational background, occupation, personal interests and relationship preferences.  You may also choose to include photo(s) [or video(s)] of yourself.  If you post personally identifiable information in areas of our website that are accessible by other users, you should be aware that such information can be read, collected or used by other users, and could be used improperly (for example, to send you unsolicited messages).  We are not responsible for any third party’s use of the personally identifiable information you choose to include in your public profile and other areas of our website that are accessible by other users.

When you subscribe to our services, you also provide us with personally identifiable information, such as your name, address, phone number, email address and credit card information.  This information is not accessible by other users of our website and is stored in your private account.

Any time you visit our website, our servers automatically collect certain information from your browser (such as your browser and platform type, your IP address and internet service provider, the date and time, the referring page, the number of clicks you make while visiting our website, and the page you exit to).  We gather this information from all users of our website and use it for administrative and analytical purposes, including diagnosing problems with our servers and improving the design of our website, analyzing trends and gathering broad demographic information, and preventing fraud.

How We Use The Information We Collect
We use your personal information in order to provide the services we offer.  Your public profile, photo(s) [and video(s)], and username are displayed in order to allow our users to interact with one another and to facilitate matching.  Our website allows you to communicate with other users without disclosing your email address, phone number or any other personal information.  Should you choose to disclose your email address, phone number or any other personal information to another user of our website, or post it in any area of our website that is accessible by other users, we cannot guarantee how they may use that information; therefore, you should always exercise caution and good common sense in disclosing any personal information.

We use your private account information primarily to process payment(s) for your subscription and other services we provide.  We process all credit card transactions through industry-standard Secure Socket Layer (SSL) and/or strong encryption (3DES) through a third party, which only uses your information for that purpose.

We use your email address to confirm transactions, such as orders, refunds and renewals, to notify you of matches or activity in your account, and to notify you of promotions, new services or upgrades to our existing services and the like.  Email messages from us may contain code that enables our servers to track whether you open the message and whether you follow any links contained in the message.  If you would rather not receive promotional emails from us, you may follow the “unsubscribe” link in any email or change the email preferences in your account settings.  We reserve the right, however, to send you certain email messages relating to our service, such as service announcements and administrative messages, without offering you the opportunity to opt out of receiving them.

In cases of suspected abuse or service problems or attacks, we may use an IP address in conjunction with other personally identifiable information in order to enforce our Terms of Use, to protect or troubleshoot our website, or to protect our website’s users or others.

In addition, we use “cookies” to keep track of some types of information while you are visiting our website or using our services.  (“Cookies” are very small files that are placed on your computer that are tied to information about you.)  Cookies allow us to count the number of visitors to our website and distinguish repeat visitors from new ones.  They also allow us to save your user preferences and track user trends.  We rely on cookies for the proper operation of our website; if your browser is set to reject all cookies, our website will not function properly.  If you set your browser to reject cookies, you assume responsibility for any resulting loss of functionality.  We are careful about the security and confidentiality of the information stored in cookies.  For example, we do not store account numbers or passwords in cookies, or otherwise link them to any personally identifiable information.

We may also use “web beacons” in our email communications in order to understand the behavior of our customers.  (“Web beacons” are small transparent graphic images that are used in conjunction with cookies in order to further personalize our website for our users and to collect a limited set of information about our visitors.)  We do not link web beacons to any personally identifiable information.

We use the demographic information that we collect to improve your user experience, identify content that we think you may be interested in and display it according to your stated preferences.

From time to time, we may also conduct user surveys to help improve our website.  All survey responses will be anonymous and will not be linked to any personally identifiable information.

We may archive the information you provide in the course of using our website, including your personal information.  We store that information on servers that are controlled by us or by third parties who have agreed in writing to comply with the pondigo.com Privacy Policy.  Archived information will not ordinarily be erased unless and until you deactivate your account with us, and even then we may retain some or all of your information in our archives.  We cannot guarantee, however, that any of that information can be made available to you after you deactivate your account.

When We Share The Information We Collect With Third Parties
We may share the information you provide to us to service providers that may be associated with us to perform functions on our behalf and help us bring you the services we offer.  For example, we may use third parties to process payments, or to provide technology assistance or customer care, and these third parties may need access to your personal information to provide service to us or to you.  Any third parties performing functions on our behalf will treat your personal information as private and confidential and will not use it for any purpose other than those specifically authorized by us.

When subscribing to our service, or from time to time during your subscription, we may offer you the opportunity to purchase complementary services from trusted third parties.  If you choose to accept any of these offers, we may navigate you to the third party’s website, where you may be asked for personal information by the third party.  Please be aware that these offers may be presented on pages framed by our website; we do this to offer you a seamless experience.  However, although these pages may have the look and feel of our website, you will be submitting information directly to the third party.  Please refer to the third party’s own privacy policy (accessible on the third party’s website) if you have any questions regarding how they may use your information.  We cannot be responsible for the use of any information disclosed by you to a third party.

We may share demographic and other non-personally identifiable information with third parties, for example, to attract third party advertisers.  In addition, we may use third party advertising agencies or other service providers to serve ads on our website on behalf of third party advertisers.  These companies may employ cookies and web beacons to measure advertising effectiveness, but we require that any information that these third parties collect via cookies and web beacons remain completely anonymous.  Some of these third-party advertising agencies may be members of the Network Advertising Initiative, which offers you the option to opt out of ad targeting from its member organizations by following the procedures listed here:

http://www.networkadvertising.org/managing/opt_out.asp

We may disclose information you provide if we are required to by law or we otherwise believe, in our sole judgment, that disclosure is necessary or reasonable in order to comply with the law or requests or orders from law enforcement or a legal process, such as a subpoena or court order, to protect or defend our rights or property or the rights or property of a third party, or to protect someone’s health or safety, such as when harm or violence against someone (including you) is threatened.  Without limiting the foregoing, we reserve the right, but have no obligation, to disclose any information that you provide to us if, in our sole opinion, we suspect or have reason to suspect that such information concerns someone who may be the victim of abuse, including sexual abuse, child abuse, elder abuse, spousal abuse, neglect or domestic violence.  We may disclose such information to authorities that we, in our sole discretion, deem appropriate, such as law enforcement officials, child protection agencies or court officials.

As we develop our business, we may buy or sell assets and, depending on the transaction, your personal information may be one of the transferred assets.  In the event that we are acquired by another company, your personal information may be acquired along with us.  If any of these events occur, you will be notified if there are any material changes to the way your personal information is collected or used.

How You Can Change Or Remove Your Information
You may change or remove any of your personal information at any time by logging into your account.  For technical reasons, any changes or deletions may take a short period of time to take effect.

If you change or delete any of the personal information in your public profile, we will remove the old or deleted information from public view.  However, as noted above, we may keep that information archived indefinitely.

Security Of Your Information
We have industry-standard security measures in place to protect against the loss, misuse or alteration of the information stored on our servers, including your personal information.  These measures include the use of Secure Socket Layer (SSL) and/or strong encryption (3DES) technology during credit card transactions and administrative access to website data, as well as other proprietary security measures that are applied to all transfers of user information.  We exercise reasonable care in providing secure transmission of information between your computer and our servers, but given that all security measures are subject to possible circumvention, we cannot provide any guarantees regarding the effectiveness of the security measures we employ or our ability to prevent third persons, acting unlawfully, from obtaining information that you provide to us.

We encourage you to maintain a pseudonymous username and use caution and good common sense when using our services or interacting with other users of our website.  We cannot guarantee that your identity, phone number, work or home address, or other contact or personally identifiable information will not be discovered by other users of our website.  It is, of course, more likely that such information will be discovered if you post photo(s) [or video(s)] or share other unique identifying information about yourself with other users of our website or on areas of our website that are accessible by other users.  We also recommend that you avoid sending personal information through insecure email.

You are responsible for all actions taken with your username and password, including fees.  Therefore, we recommend that you do not share your username or password with anyone.  In addition, anyone with access to your username and password may gain access to your personal information.  Please contact us immediately if you believe your login information has been compromised in any way.  Please feel free to visit the Federal Trade Commission’s website at http://www.ftc.gov/bcp/menus/consumer/data.shtm for additional information about how to protect yourself against identity theft.

Our website may contain links to other websites, including links embedded in advertisements that appear on our website.  We are not responsible for the privacy practices of other websites.  We encourage you to be aware of the privacy policies of each and every website that you navigate to that collects personal information.  This privacy policy applies solely to us and to our website.

Your Acceptance Of This Privacy Policy And Future Changes To It
Your use of our website, including any dispute concerning privacy, is subject to this privacy policy and our Terms of Use.  BY USING OUR WEBSITE, YOU ACCEPT THIS PRIVACY POLICY AND OUR TERMS OF USE.

We reserve the right to change our privacy policy at any time.  If we do this, we will post the changes to this policy on this page and any other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we may disclose it.  If we make material changes to this policy, we will notify you here, or by other means, such as email, at our discretion.  Your continued use of any portion of our website following the posting of any updated privacy policy will constitute your acceptance of the changes.

The effective date of this privacy policy is October 30, 2009.
